I was stuck between B and E? To be honest, I didn't think either met the definition. I just thought the uncertainty was the uncertainty of the law's stance on how to prove rightful ownership of the art work...

Tough question because it seems to be asking about a tiny detail, but knowledge of the passage as a whole is essential for answering it.

Quick and dirty tiebreaker for B and E: the passage is about law, choose the answer that includes law.

(A) nothing to do with moral rights.
(B) yes. the "inherent uncertainty" is the starting point for the entire passage's discussion. Paragraph 2, lines 15-19 give us the support we need for this choice. It's about law and time (statute of limitations).
(C) nothing to do with correct age
(D) no institutional dispute mentioned
(E) seems like a good match at first, but is wrong because of C's better match to the passage as a whole, and because "damage" is never mentioned -- it's all about theft and ownership, never about damage.
