I don't understand why the answer is D but not B. I was stuck between the two and chose B which is wrong but they sound almost identical to me.

B says the main purpose is to evaluate the theory of legal positivism and D says to identify the basic tenets of legal positivism. I don't see how it's doing one without the other.

I feel like I get questions like this wrong very often. Could someone clear it up for me please?

The second paragraph tells us what legal positivism is--notice that there isn't discussion evaluating it until paragraph three. The difference between (B) and (D) is subtle but there: it's one thing to identify what something is and another to evaluate it, which means to analyze its merits.

(A) is unsupported because the discussion isn't focused on examining the reasons for its popularity.

(C) is out of scope, and (E) is problematic for the same reason (B) is--we don't have a discussion evaluating the merits in one way or another.
